ELECTRONIC PLATFORM
TERMS AND CONDITIONS
The electronic platform, which includes but is not limited to the application (“App”) and our website (including any other electronic platform or channel that may be available from time to time, collectively referred to as “our Website”), is provided by 3 Sing Trustee Ltd (“we”, “us” or “our”, which shall include our successors and assigns). Before downloading or using any part of the electronic platform, you are required to read these Terms and Conditions carefully. By downloading or using the electronic platform, you shall be deemed to have accepted and agreed to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you must not download or use any part of the electronic platform.
1. The Electronic Platform and Its Functions
1.1 3 Sing Trustee apps provides digital services through the Electronic Platform. The Electronic Platform is intended for use by either individual customers or, where the customer is a corporate entity, by those authorized users who are designated by such entity to access and use the Electronic Platform on its behalf. The term “you” as used in these Terms and Conditions refers to the individual customer or the corporate customer, including each authorized user designated by such corporate customer. The App may be downloaded solely from mobile application stores designated or approved by us from time to time.
1.2 Our services are delivered exclusively by electronic means. We implement safeguards to manage and control associated risks in accordance with applicable regulatory requirements and prevailing market practices. However, we do not warrant or guarantee that any electronic channel or network is completely secure. Use of the Electronic Platform is not risk-free. If you do not accept this risk, you must refrain from downloading or using any part of the Electronic Platform.
1.3 These Terms and Conditions govern both our provision of, and your use of, the Electronic Platform. They constitute a legally binding contract between you and the 3 Sing Trustee, and set forth the respective rights and obligations of the parties. Upon activation of relevant authorizations, you may utilize network functions, and we may send you notifications upon your request. Activation of camera authorization allows us access to your device’s camera for the purposes of profile settings and uploading information. Activation of storage authorization permits us to collect and store information such as photographs under networked conditions. Activation of device information permission authorizes us to obtain your device’s unique identifier for login and quick login functionalities.
1.4 We reserve the right to establish and amend at our sole discretion the conditions, procedures, hours of availability, daily cut-off times for accessing the Electronic Platform, and other operational limits.
1.5 We further reserve the right to amend these Terms and Conditions at any time by posting an updated version within the Electronic Platform. You are responsible for reviewing the latest version regularly. Continued use of the Electronic Platform following any such amendment shall constitute your acceptance thereof. If you do not accept any such amendment, you must immediately cease use of the Electronic Platform.
2. Security Matters – Risks and Your Responsibilities
2.1 You are required to implement, at a minimum, the following security measures when using the Electronic Platform. This enumeration is not exhaustive. You must also comply with any supplementary security advice we may provide via the Electronic Platform or any other communication channel as we deem appropriate.
2.2 With respect to your accounts and services accessed through the Electronic Platform:
- (a) Use only encrypted and reliable mobile internet connections. Do not operate your accounts or access our services over public or unsecured wireless networks.
- (b) Access your accounts and our services only on the mobile device you have registered with us (“Designated Device”).
2.3 With respect to the App:
- (a) Download the App solely from trusted mobile application stores (such as the Google Play™ Store and Apple App Store) or from other application stores designated or approved by us, or by scanning the specified QR code provided on our website. If you encounter a suspicious application or source, do not proceed with download, installation, login, or activation.
- (b) Regularly install updates and security patches for the App, operating systems, and browsers from the approved sources or from our website.
- (c) Do not download the App using public or unsecured wireless networks.
2.4 With respect to the Designated Device and your security information:
- (a) Download and use the App and access your accounts and our services only on the Designated Device.
- (b) Do not use the App on any device or operating system that has been altered outside the scope of vendor-supported configurations (including “jail-broken” or “rooted” devices).
- (c) Do not connect the Designated Device to any computer suspected of being infected with malware or viruses.
- (d) Install anti-virus software, firewalls, and other security tools on the Designated Device. Reference: HKCERT Mobile Security Tools.
- (e) When not in use, disable wireless functions (such as Wi-Fi, Bluetooth, NFC) and log out of the Electronic Platform. Use encrypted networks and disable automatic Wi-Fi connections.
- (f) Enable the auto-lock function on the Designated Device.
- (g) When setting passwords, login credentials, and security information:
- Do not use easily guessed personal information, numbers, or words.
- Do not record passwords, login credentials, or security information without disguising them.
- Do not store such information on or near the Designated Device.
- Do not use identical credentials for multiple services.
- Change your passwords and credentials regularly.
- (h) Keep the Designated Device, passwords, login credentials (including biometric credentials), and security information confidential. Do not share these with any other person. Protect them from loss, theft, accidental or unauthorized disclosure or use.
- (i) Notify us via our designated reporting channels as soon as practicable if you suspect that the Designated Device or any credentials or security information have been lost, stolen, disclosed, or used without authorization. Promptly change your credentials thereafter.
- (j) Do not store biometric credentials of any person other than yourself on the Designated Device.
- (k) Prior to relinquishing possession of the Designated Device for repair or disposal, delete the App and all stored credentials and security information.
3. Use of the Electronic Platform
3.1 You must use the Electronic Platform in a prudent and responsible manner. The Electronic Platform must not be used for any unlawful purpose or in any unlawful manner. We reserve the right to suspend or terminate your access to the Electronic Platform or its content at any time upon breach of this provision.
3.2 Use of the App may require you to enter into separate license agreements with third-party software providers (including, but not limited to, Google Play™ Store and Apple App Store) and you will be subject to their terms and conditions. We are not a party to such license agreements and accept no liability for the acts, omissions, products, or services of such providers.
3.3
The Electronic Platform, related materials, products, and services are not provided for, nor intended to be accessed or used by:
- (a) any person in any jurisdiction where such access or use would contravene applicable laws or regulations;
- (b) any person in any jurisdiction where we are not licensed or authorized to provide such services; or
- (c) any person in a jurisdiction subject to sanctions or for any other reason we deem appropriate.
3.4 You are solely responsible for ensuring that your access to and use of the Electronic Platform and related materials, products, and services comply with all applicable laws and regulations. By using or accessing the Electronic Platform, you represent and warrant your compliance with all such requirements.
3.5 Hyperlinks to external internet sites or resources are accessed at your own risk. We make no representation or warranty as to the accuracy, quality, or security of content provided by such external sites.
3.6 You may discontinue use of the App at any time by deleting it from your Designated Device.
4. Biometric Authentication
4.1 You may use your biometric credentials stored on the Designated Device to log in to the App and authorize transactions, subject to our specifications on the types and manner of biometric credentials permitted (e.g., fingerprint, facial recognition).
4.2 By using biometric authentication, you authorize us to act upon instructions verified by your biometric credentials. Such instructions and resulting transactions are binding upon you. We are not obliged to take further steps to verify the identity of the person providing instructions authenticated by biometric credentials but reserve the right to require password or other personal credential authentication.
4.3 Preconditions for using biometric authentication:
- You have successfully opened an account with us.
- The App is installed on your Designated Device.
- The biometric authentication function on the Designated Device is activated, and at least one of your biometric credentials is registered.
- You have completed registration for biometric authentication through the App using personal credentials as specified or accepted by us.
- You must maintain the confidentiality of the credentials used to register and store your biometric information.
4.4 Your responsibilities regarding biometric authentication:
- After registration, any biometric credential stored on the Designated Device may be used for authentication. You must ensure that only your own biometric credentials are stored.
- Do not use biometric authentication if you believe another person may have identical or very similar biometric credentials (e.g., a twin).
- Do not use biometric authentication if your biometric credentials are likely to change.
- You authorize biometric authentication performed through the App’s interface with your device’s biometric module. We do not collect or store your biometric credentials for this purpose.
- We make no warrant as to the quality or performance of your device’s biometric module.
- If your biometric credentials are changed or biometric authentication is not used for a period of time, re-registration or re-activation may be required.
4.5 You may cancel biometric authentication at any time in accordance with our specified procedures. Biometric credentials stored on your device will not be deleted automatically upon cancellation; you are responsible for their deletion.
5. Your Personal Data
5.1 You warrant and represent that all information provided by you via the Electronic Platform is true, accurate, complete, and up-to-date.
5.2 You consent to our use and disclosure of your personal data provided via the Electronic Platform for the purposes and in the manner set out in our Personal Information Collection Statement (“PICS”), which is provided to you at the time of data collection and is also available via the Electronic Platform. You understand and agree that your personal data may be processed or stored in or outside the Hong Kong Special Administrative Region.
6. Fees and Charges
6.1 You are solely responsible for all fees and charges imposed by your telecommunications or network service provider in connection with your use of the Electronic Platform and/or the device used to access or download the App.
7. Intellectual Property
The Electronic Platform and all related content are protected by copyright and other intellectual property rights. You may not modify, reproduce, transmit, or distribute any part of the Electronic Platform or related materials for commercial or public use without our prior written consent.
8. Limitation of Liability
8.1 The Electronic Platform is provided on an “as is” and “as available” basis. We make no representation or warranty, express or implied, regarding the quality, availability, or operation of the Electronic Platform. All information provided through the Electronic Platform is for reference only.
8.2 To the fullest extent permitted by law, we disclaim all warranties and liabilities, including but not limited to:
- uninterrupted or error-free operation of the Electronic Platform, or the rectification of any defects;
- fitness of the Electronic Platform for any particular purpose; and
- absence of viruses or other harmful components, or immunity from damage to your device or equipment arising from use of the Electronic Platform.
8.2 Without prejudice to any other provision herein, we disclaim all responsibility for any delay, error, omission, loss, or damage arising from: (i) your improper use of the Electronic Platform or non-compliance with these Terms and Conditions; or (ii) any mechanical failure, malfunction, or interruption of our systems or those of any provider beyond our reasonable control.
9. Indemnity
9.1 Without limiting any other indemnity or remedy available to us, you agree to indemnify and hold harmless us and our officers, employees, and agents from and against any and all liabilities, claims, demands, losses, damages, costs, charges, and expenses (including full indemnity legal fees) incurred directly or indirectly as a result of or in connection with your use of the Electronic Platform or your failure to comply with these Terms and Conditions.
9.2 The foregoing indemnity does not apply to the extent that it is proven that such claims, losses, or expenses arise directly and solely from our negligence or willful misconduct. This indemnity shall survive termination of your use of the Electronic Platform, accounts, and services.
10. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. The parties submit to the non-exclusive jurisdiction of the courts of Hong Kong.
11. Language
The Chinese version of these Terms and Conditions is for reference only. In the event of any inconsistency between the Chinese and English versions, the English version shall prevail.
